RECITALS

Activated Ministries is organized under the California Nonprofit Religious Corporation Law and under the federal Internal Revenue Code Section 501(c) (3). The specific purposes for which this corporation is organized are to develop and implement programs for Christian evangelism and spiritual growth; to teach the principles of God’s Word through the distribution of Christian literature, audio and video material, and any other prudent means available; to provide financial, physical and material support to missionaries of the Gospel, particularly those of the missionary fellowship known as "The Family International"; and to strengthen families and children by promoting and teaching the moral values and character-building principles of the Bible.

TERMS OF USE

  1. As part of Activated Ministries' purpose to assist Christian missionaries in their goals of evangelizing and strengthening believers Activated Ministries maintains www.getactivated.org as resource site and online store for our Missionary Outreach Program through which we provide Christian magazines, books, teaching materials, audio/video materials and other products at a minimum cost to Christian missionaries use in their ministries. These terms of use set forth the terms and conditions governing your use of www.getactivated.org and your access to and use of the information, content and services offered on or through www.getactivated.org. By accessing or using the www.getactivated.org, you agree to be legally bound by these terms. If you do not agree to these terms and conditions, you may not use the Site or download any of our materials. These terms may be modified by Activated Ministries from time to time; you should visit www.getactivated.org periodically to review the current terms and conditions. Your continued use of this www.getactivated.org following the posting of changes to these Terms will mean you accept those changes.
  2. Missionary Requirement
    www.getactivated.org is a resource site for missionaries who are members of The Family International. By using this site you affirm that you are a member in good standing of the missionary fellowship known as “The Family International”. And if you cease to be a member in good standing you agree to discontinue use of this site.
  3. Rules of behavior while using www.getactivated.org.
    You will not:
    1. defame, abuse, harass or threaten others;
    2. make, post, or distribute, any bigoted, hateful, racially offensive, threatening, harassing, vulgar, obscene, discourteous, or indecent languages, images, statements or other objectionable materials;
    3. advocate, discuss with the intent to commit, or commit and illegal activity;
    4. post or distribute any material that infringes and/or violates any right (including but not limited to intellectual property of a third party or any law);
    5. make any attempt to penetrate, modify or manipulate the Site to invade the privacy of any other user of the Site;
    6. attempt to modify, erase or damage any information contained on the Site;
    7. reverse engineer any portion of the Site;
    8. restrict or inhibit others from using the Site;
    9. spoof or otherwise impersonate any individual or entity; or
    10. violate or attempt to violate the security or integrity of the Site or of any computer system.
  4. Information You Submit
    On www.getactivated.org we accept certain information from you. The information you submit and that we may collect in the course of your use of www.getactivated.org is also governed by our current Privacy Policy posted at . The terms of the privacy policy are incorporated into these Terms by this reference.
  5. Representations, Warranties and Acknowledgment
    THE MATERIALS IN THIS ACTIVATED MINISTRIES WEB SITE AND OTHER AFFILIATED SITES ARE PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO THOSE OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, OR TITLE. ACTIVATED MINISTRIES’ SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE UPON A CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS RELATING TO THE PRODUCTS IT SELLS WHICH EXCEEDS THIS LIABILITY LIMIT. ACTIVATED MINISTRIES’ SHALL NOT BE LIABLE FOR THIRD PARTY CLAIMS FOR DAMAGES AGAINST THE CUSTOMER, OR FOR MALFUNTION, DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS, LOSS OR DAMAGE TO EXEMPLARY DAMAGES, WHETHER OR NOT ACTIVATED MINISTRIES’ IS APPRISED OF THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES.

    You agree to indemnify and hold Activated Ministries its subsidiaries, officers, employees, and contractors harmless from any claims and expenses, including reasonable attorney's fees, related to your violation of this Agreement, including any abusive or unlawful behavior on your part, or the infringement of any intellectual property or privacy right of any person.
  6. Third Party Sites
    www.getactivated.org may link to third-party sites. These links are provided for your convenience, and Activated Ministries assumes no responsibility for any content made available at any third party site. Such third party sites may be subject to their own terms of use and privacy policies. Activated Ministries urges you to read the posted terms and policies of these third-party sites.
  7. Violations of these Terms or the Law
    Activated Ministries reserves the right to investigate and to involve and cooperate with law enforcement authorities, and to pursue a civil lawsuit or criminal prosecution for any alleged or actual harmful or illegal activities involving any of the Site. Activated Ministries reserves the right, at any time, to modify or discontinue, temporarily or permanently, www.getactivated.org, with or without notice. Your access to any and all Activated Ministries Web sites may be terminated immediately without notice from us if in our sole discretion you fail to comply with any provision of these Terms. Upon termination, you must cease use of www.getactivated.org and destroy all materials obtained from www.getactivated.org and all copies thereof. Activated Ministries shall not be liable to you or any third-party for any termination of your access to www.getactivated.org.

    We are not responsible for typographical errors. All trademarks are registered trademarks of their respective companies. We reserve the right to refuse sale for any reason, to verify payment before shipping, or to ship only to billing address of credit card.

    These Terms will be governed by and construed in accordance with the internal laws of the State of California, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the appropriate state and federal courts in the State of California with respect to claims you may have under these Terms. These Terms constitutes the entire agreement between you and Activated Ministries with respect to its subject matter, superseding any prior oral or written agreements relating to such subject matter. The failure of Activated Ministries to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. If a court of competent jurisdiction finds any provision of these Terms to be invalid, the court should endeavor to give effect to the parties' intentions to the maximum extent consistent with applicable law, and the other provisions of these Terms shall remain in full force and effect.
